Welcome to the Selise Studios Affiliate Program. By registering and participating as an Affiliate Marketer, you agree to the following terms and conditions outlined in the Selise Studios Affiliate Marketer Agreement. Please carefully review these terms, as they govern your rights, responsibilities, and participation in the program.

1. Affiliate Program Participation
By registering for the Selise Studios Affiliate Program, you agree to promote Selise Studios products in accordance with the guidelines provided by the Company. Your participation is contingent upon the execution of a signed Affiliate Marketer Agreement. You are responsible for accurately representing the brand and complying with all legal advertising guidelines, including FTC requirements.

2. Commissions and Payouts
Commissions will be paid based on the qualifying sales generated through your unique affiliate links. Commissions are calculated on the final sale price after all discounts and promotions (including affiliate discounts) have been applied. Shipping costs and taxes are excluded from commission calculations.

Payouts will be processed through the Shopify Enlistly App and distributed on a monthly basis, once your earnings reach the minimum threshold set by the Company. The specific commission rate is determined individually and specified in your Affiliate Marketer Agreement.

3. Non-Exclusivity
While the Affiliate Program does not create an exclusive relationship, you agree not to promote or represent any products that directly compete with Selise Studios during the term of this Agreement. Competing products include, but are not limited to, candles, home fragrances, and candle accessories.

4. Non-Compete Agreement
You agree that during the term of this Agreement and for a period of five (5) years following the termination of this Agreement, you will not promote, sell, distribute, or represent any products, brands, or services that directly compete with Selise Studios in the candle or home fragrance industry. This non-compete applies globally and is intended to protect Selise Studios' trade secrets, intellectual property, and customer relationships.

Violation of this non-compete obligation may result in legal action, including but not limited to injunctive relief and recovery of damages.

5. Content and Promotion Guidelines
You agree to promote Selise Studios products on approved platforms in a manner that aligns with the brand’s values and accurately represents the products. All promotions must include appropriate disclosure of your affiliate relationship (e.g., #ad, #affiliate) in compliance with FTC guidelines.

Selise Studios reserves the right to request the removal of any content that is deemed inappropriate, misleading, or inconsistent with the brand’s image. Failure to comply with the content guidelines may result in the suspension or termination of your participation in the program.

6. Termination
Selise Studios reserves the right to terminate your participation in the Affiliate Program at any time, with or without cause. Upon termination, you will no longer be eligible to promote Selise Studios products or receive commissions for future sales generated through your affiliate links.

7. Limitation of Liability
Selise Studios makes no guarantees regarding the level of success or income you may achieve through participation in the Affiliate Program. All participation is at your own risk, and Selise Studios provides no warranty for tracking systems or program availability.

In no event shall Selise Studios be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your participation in the program.

8. Indemnification
You agree to indemnify and hold harmless Selise Studios, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of the Affiliate Marketer Agreement, violation of applicable laws, or improper promotion of Selise Studios products.

9. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the state of [State], without regard to its conflict of law provisions.

By participating in the Selise Studios Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and the Affiliate Marketer Agreement.
